BRISTLELAB.PL ONLINE STORE TERMS AND CONDITIONS

§ 1. GENERAL PROVISIONS

1. The online store available at www.bristlelab.pl is operated by BRISTLE LAB Vladyslav Hrabovskyi, conducting business activity as a sole proprietorship, with the address of business: ul. Hoża 86/410, 00-682 Warsaw, NIP: 1251806422, REGON: 544367452, email address: contact@bristlelab.pl, phone number: +48 780 112 165, hereinafter referred to as the "Seller" or "Service Provider".

2. These Terms and Conditions define the rules for using the Online Store, in particular:
a) rules for using electronic services provided in the Store,
b) rules for placing Orders,
c) rules for concluding Sales Agreements,
d) rules for payment and delivery,
e) rules for submitting and processing complaints,
f) rules for withdrawal from the contract.

3. The Terms and Conditions are addressed to both Consumers and Entrepreneurs, unless a given provision states otherwise.

4. The provisions of the Terms and Conditions concerning the Consumer also apply to a natural person concluding a contract directly related to their business activity, when the content of this contract indicates that it is not of a professional nature for this person, resulting in particular from the subject of the business activity performed as disclosed in the CEIDG (Central Register and Information on Business Activity), provided that applicable regulations grant such a person appropriate protection.

5. The administrator of personal data processed in connection with the implementation of the provisions of these Terms and Conditions is the Seller. Detailed rules for processing personal data are set out in the Privacy Policy available on the Store's website.

§ 2. DEFINITIONS

1. Business day – a day from Monday to Friday, excluding public holidays.
2. Customer – a natural person, legal entity or organizational unit without legal personality, to which the law grants legal capacity, using the Store or concluding a Sales Agreement.
3. Consumer – a natural person performing a legal action with the Seller not directly related to their business or professional activity.
4. Account – an electronic service, a collection of data in the Store's ICT system identified by an individual login, where Customer data and information about their Orders are stored.
5. Newsletter – an electronic service consisting of sending commercial, marketing information and content related to the Store to the provided email address, after expressing appropriate consent.
6. Product – a movable item offered in the Store, being the subject of a Sales Agreement.
7. Entrepreneur – a Customer who is not a Consumer.
8. Terms and Conditions – these Terms and Conditions of the Online Store.
9. Store – an online store operated at www.bristlelab.pl.
10. Sales Agreement – a contract for the sale of a Product concluded between the Customer and the Seller through the Store.
11. Electronic service – a service provided electronically by the Service Provider to the Customer through the Store.
12. Order – the Customer's declaration of will directly aimed at concluding a Sales Agreement.

§ 3. ELECTRONIC SERVICES IN THE STORE

1. The following electronic services are available in the Store:
a) Account,
b) Order Form,
c) Newsletter.

2. Account.
a) An Account is created by filling out the registration form and providing the required data.
b) The Account service is provided free of charge for an indefinite period.
c) The Customer may delete the Account at any time through the appropriate function in the Account or by contacting the Seller at contact@bristlelab.pl.

3. Order Form.
a) Using the Order Form begins when the first Product is added to the cart.
b) An Order is placed after filling out the form and clicking the button finalizing the purchase with the obligation to pay.
c) Until the Order is placed, the Customer has the possibility to independently correct the entered data.

4. Newsletter.
a) Subscription to the Newsletter is done by providing an email address and expressing appropriate consent or by checking the relevant box, if such a function is available.
b) The Newsletter service is provided free of charge for an indefinite period.
c) The Customer may unsubscribe from the Newsletter at any time by using the unsubscribe link or by contacting the Seller.

5. Technical requirements necessary to use the Store:
a) a device with Internet access,
b) an up-to-date web browser,
c) an active email account,
d) enabled support for cookies and JavaScript, if necessary for the proper functioning of the Store.

6. The Customer is obliged to use the Store in a manner consistent with the law, good customs and respecting the rights of third parties. It is forbidden to provide unlawful content.

§ 4. PLACING ORDERS AND CONCLUDING A SALES AGREEMENT

1. Information about Products presented in the Store constitutes an invitation to conclude a contract, not an offer within the meaning of the Civil Code.

2. The Customer can place Orders 24 hours a day, 7 days a week, subject to technical breaks.

3. To place an Order, the Customer:
a) selects a Product or Products,
b) adds them to the cart,
c) fills in the required data,
d) selects the delivery and payment method,
e) accepts the required declarations,
f) finalizes the Order with the button confirming the obligation to pay.

4. After placing the Order, the Seller immediately sends the Customer an email confirming receipt of the Order. This message does not yet constitute acceptance of the Order for processing or confirmation of the conclusion of the Sales Agreement.

5. The Sales Agreement is concluded when the Seller sends the Customer a separate email containing an explicit statement of acceptance of the Order for processing.

6. The content of the concluded Sales Agreement is recorded, secured and made available to the Customer through:
a) making these Terms and Conditions available on the Store's website,
b) sending emails regarding the Order,
c) saving Order data in the Store's system.

§ 5. PRICES AND PAYMENT METHODS

1. Product prices presented in the Store are given in Polish Zlotys and are gross prices, meaning they include taxes required by law, unless expressly stated otherwise.

2. The Customer is informed about the total price of the Product, delivery costs and any other costs during the ordering process, before its final submission.

2a. In every case of informing about a price reduction of a Product, the Seller shall also display, next to the information about the reduced price, information about the lowest price of that Product which was in effect within 30 days before the reduction was introduced, and if the Product has been offered for sale for a period shorter than 30 days – information about the lowest price from the date of commencement of offering that Product until the date the reduction was introduced.

3. The following payment methods are available in the Store:
a) BLIK,
b) Apple Pay,
c) Google Pay,
d) payment by payment card.

3a. Currently available payment methods are always presented to the Customer on the Store's website and during the ordering process.

4. Payment processing is carried out through payment operators currently available in the Store and at checkout.

5. If payment is not successfully authorized, the Seller may refuse to fulfill the Order.

§ 6. DELIVERY AND ORDER FULFILLMENT

1. Delivery of Products is carried out in the territory indicated by the Store during the ordering process.

2. Available delivery methods include, in particular: InPost,

3. Delivery costs are indicated to the Customer during the ordering process.

4. The Order fulfillment time and the estimated delivery time are indicated to the Customer in the Store or during the ordering process. The time may depend on Product availability, the selected delivery method, and the payment crediting date.

5. In the case of an Order including Products with different fulfillment times, the longest given time is binding, unless the parties agree otherwise.

6. The risk of accidental loss or damage to the Product passes to the Consumer at the moment the Product is handed over to the Consumer. In the case of an Entrepreneur, the risk passes in accordance with the relevant legal provisions and the provisions of these Terms and Conditions.

§ 7. PRODUCT COMPLAINTS

1. The Seller is liable to the Consumer for any non-conformity of the Product with the contract existing at the time of delivery of the Product and revealed within 2 years from the date of delivery of the Product.

2. Complaints can be submitted:
a) electronically to the address: contact@bristlelab.pl,
b) in writing or together with the complaint shipment to the address:
ul. Wólczyńska 133, bud. 6 magazyn. 11/4, 01-919 Warszawa

3. To streamline the complaint process, it is recommended to provide:
a) identifying data of the Customer and the Order,
b) description of the non-conformity,
c) date of noticing the problem,
d) Customer's request.

4. Providing the information indicated in paragraph 3 is only for assistance and does not constitute a condition for effective submission of a complaint.

5. In case of non-conformity of the Product with the contract, the Consumer may demand:
a) repair of the Product, or
b) replacement of the Product.

6. In cases provided for by law, the Consumer may also submit a statement of price reduction or withdrawal from the contract.

7. The Seller will respond to the complaint within 14 days from the date of its receipt.

8. If the complaint is deemed justified, the Seller bears the costs of bringing the Product into conformity with the contract, including the costs of collection, delivery, repair, replacement, labor, and materials, in accordance with applicable law.

§ 8. ELECTRONIC SERVICES COMPLAINTS

1. Complaints regarding the operation of the Store, Account, Newsletter or other electronic services can be submitted to contact@bristlelab.pl.

2. In a complaint regarding electronic services, it is recommended to indicate:
a) the type of problem,
b) the date of its occurrence,
c) the contact details of the complainant.

3. The Seller will consider the complaint regarding electronic services immediately, no later than within 14 days from the date of its receipt, unless legal provisions provide for a different deadline.

§ 9. RIGHT OF WITHDRAWAL FROM THE CONTRACT

1. A Consumer who has concluded a distance contract has the right to withdraw from the contract without stating a reason within 14 days, subject to exceptions resulting from legal provisions.

2. Detailed rules for exercising the right of withdrawal from the contract, including the method of submitting the statement, the return address, payment return rules and exceptions to the right of withdrawal, are defined on a separate page "Withdrawal from the contract" available in the Store.

§ 10. OUT-OF-COURT METHODS OF DISPUTE RESOLUTION

1. The Consumer has the option of using out-of-court methods for resolving complaints and pursuing claims.

2. Detailed information on out-of-court methods of consumer dispute resolution and on entities authorized to conduct such proceedings is available, in particular:
a) on the UOKiK website,
b) on the polubowne.uokik.gov.pl website,
c) from the locally competent consumer ombudsman or the Provincial Inspectorate of Trade Inspection.

3. The use of out-of-court dispute resolution methods is voluntary, unless legal provisions state otherwise.

§ 11. PROVISIONS CONCERNING ENTREPRENEURS

1. The provisions of this paragraph apply only to Customers who are not Consumers, subject to the rights of natural persons conducting business activity who are granted protection similar to that of consumers by law.

2. At the moment the Product is handed over to the carrier, the benefits and burdens associated with the Product, as well as the risk of accidental loss or damage to the Product, pass to the Customer who is not a Consumer.

3. A Customer who is not a Consumer is obliged to examine the shipment immediately upon receipt and take necessary actions to determine the carrier's liability if damage or deficiency occurred during transport.

4. To the fullest extent permitted by law, the Seller's liability towards a Customer who is not a Consumer under warranty is excluded.

5. The Seller's liability to a Customer who is not a Consumer is limited to actual damage and to the value of the Order from which the claim arises, unless mandatory legal provisions state otherwise.

6. Any disputes between the Seller and a Customer who is not a Consumer will be resolved by the court locally competent for the Seller's registered office, unless legal provisions state otherwise.

§ 12. FINAL PROVISIONS

1. The Terms and Conditions are available free of charge on the Store's website in a manner enabling their acquisition, reproduction, and retention.

2. Contracts concluded through the Store are concluded in Polish.

3. The Seller reserves the right to amend the Terms and Conditions for important reasons, in particular due to:
a) changes in legal regulations,
b) changes in payment or delivery methods,
c) technical or organizational changes related to the functioning of the Store.

4. For Sales Agreements concluded before the entry into force of the new Terms and Conditions, the Terms and Conditions applicable at the time of concluding the Sales Agreement shall apply.

5. In the case of continuous services, in particular the Account or Newsletter, the Customer will be informed of any changes to the Terms and Conditions with appropriate advance notice, if applicable regulations require it.

6. In matters not regulated by these Terms and Conditions, generally applicable provisions of Polish law shall apply, in particular the Civil Code, the Consumer Rights Act, and the Act on Providing Services by Electronic Means.
